Investor selects investment project of regional center and signs contracts with regional center. Investor wires investment capital $500,000 to the escrow account of regional center’s project.
Investor’s lawyer and investor prepare the I-526 Immigrant Petition by Alien Entrepreneur (I-526 Petition) and supporting documents.
Investor’s lawyer files I-526 Petition to US Citizenship and Immigration Services (USCIS)
Upon approval of I-526 Petition, USCIS transfers the approval to US Department of State National Visa Center (NVC) for immigrant visa (IV).
If the investor stays in the U.S. with legal status, he/she can file I-485 Adjustment of Status Application (green card application) with USCIS directly after I-526 petition approval.
NVC issues IV Fee Bills, IV application instruction, list of supporting documents and DS-260 IV application instruction. Upon completion of its review, NVC forward the IV application packet (called packet 3) to US Consulate in investor’s country for IV interview.
US Consulate issues IV interview notice and instruction and requests medical examination in designated hospital.
Investor receives his/her immigrant visa after passing the interview
Investor must enter the US within 180 days after his/her immigrant visa is granted
Lawyer files I-829 Petition for Removal of Conditions on Permanent Resident Status to obtain formal green card at the end of the two year anniversary of obtaining conditional green card.
USCIS reviews and processes I-829 Petition
Investor files application for naturalization to US citizenship (voluntarily) five (5) years after obtaining the green card.
Upon becoming a US citizen, investor can file green card application for his/her parents, married son/daughter and sisters/brothers.
