了解您的权利:若美国移民与海关执法局来到您家时, 如何应对

所有生活在美国的人民,包括非法移民,拥有美国宪法赋予的部分权利。如果您是非法移民,而且美国移民与海关执法局(ICE)找上了门,您必须知道您拥有以下的权利:

  • 您有权不开门。除非移民局官员有法官签署的有效搜查令,否则您有权不开门或有权不让移民局官员进入您家。
    • 美国移民与海关执法局的驱逐令并不等同于搜查令。如果他们只有驱逐令,他们不能合法地进入您家,除非您口头同意他们进入。
    • 如果移民局官员表示他们有法官签署的搜查令,请他们从门底下递进来或者在窗户上展开,以便您可以看到。
    • 如果搜查令上面的姓名和地址与您的信息不一致,而且没有法官的签名,那么您有权不开门或者有权不让他们进入。

    • 您可以向移民局官员出示权利信息卡,表示您将保持沉默并需要和律师说话。
  • 您可以拒绝出示与出生地点相关的身份证件。
  • 不要出示假证件,不要撒谎。
  • 您有权与律师说话。.如果您被拘留或拘捕,您有权立即联系一名律师。
    • 即使您没有律师,您可以告诉移民局官员您需要一名律师。
    • 如果您有律师,您有权和他们说话。如果您有一份签了名的 Form G-28,上面显示您有律师,请把他交给移民局官员。
    • 如果您没有律师,请向移民局官员索要一份公益律师清单。

All people living in the United States, including undocumented immigrants, have certain U.S. Constitutional rights. If you are undocumented and immigration (ICE) agents knock on your door, know that you have the following rights:

  • You do not have to open the door. You do not have to open the door or let the officers into your home unless they have a valid search warrant signed by a
    • An ICE deportation warrant is not the same as a search warrant. If this is the only document they have, they cannot legally come inside unless you verbally agree to let them
